Maziar Bahari !!!

Maziar Bahari is an Iranian-Canadian playwright, film-maker and journalist. During the 2009 election protests, Bahari was arrested, held in solitary confinement, and beaten for crimes such as insulting the Supreme Leader and undermining the security of the state.
Bahari was in prison for 118 days and after that he was sentenced for 13.5 years in prison .
This is only because he was supporting Iranian rights to have a the freedom of internet and speech .
Here there is a video from him that is talking about the freedom of internet in Iran .

Iran Internet Law

ISP is The first Internet Service Providers in Iransince 1994. In 2001 the law stated that Iran was to control all ISP's. The main state media entity is the Telecommunications Company of Iran (TCI). The Data Communication Company of Iran (DCI) is the chief ISP, the provider by which most other ISP's get their Internet connectivity. The DCI is a subsidiary of TCI, and run by the newly re-named Ministry for Information and Communication Technology (“ICT”), which is responsible for TCI policy.

All private ISPs must be vcontrol by both DCI and the Ministry of Culture and Islamic Guidance. ISPs must install filters for Web sites and e-mail. The TCI in 2001 issued regulations requiring ISPs to filter all materials presumed immoral or contrary to state interests. The goal of filtering is to block all access to "non-Islamic" sites. There have been many cases of bloggers and other Internet users being arrested, and some sent to prison, and even tortured and killed. In fact, a group of school children were recently taken into custody and held for several days, charged with arranging romantic rendezvous.

On October 11, 2006, the Government ruled that high-speed service is illegal, undoubtedly to fight the downloading of subversive materials. Unfortunately, this directly contradicts the Government's “Five Year-Development Plan” that had as a goal the creation of widespread access to broadband service. Despite the ruling, broadband is available in many businesses. Overall, Iranian Internet use has grown more quickly than in any other Middle Eastern country since 2,000 ..........

http://www.i-policy.org/2009/12/iranian-internet-law.html

I just put a part of article that explains the internet law in Iran and the sections .
I think Internet law in Iran is totally one sided , and the only side that has the benefit is the government .
You can't see anything about users privacy . The law is all about political issues and religious issues .
The punishments are only for those against the government .

Siemens and Nokia case !

Tehran (AsiaNews/Zamaneh) – Isa Saharkhiz, an Iranian political prisoner, has filed an official complaint with the US Federal Court against Nokia Siemens and its subsidiaries, for complicity with the Iranian government in the violation of human rights by the “sale and provision of surveillance technology and equipment for monitoring of wireless networks and the internet to Iran”.
http://www.speroforum.com/a/38405/Iran---Nokia-Siemens-Tehrans-accomplice-in-violating-human-rights

Recently some IT companies are trying to help Iranian government to monitor the wireless activities in Iran . They sale the equipment of that purpose and receive high amount of money.
I believe that this kind of equipment is necessary for government to protect the online transactions and to detect the crimes , but not to monitor the privacy of people just for political aims .
Only those countries can use this equipment that they are developed enough to support the human rights .
The international law organizations must monitor the IT companies and their activities to avoid such shameful activities that happens just for MONEY !

Zahra Amir Ebrahimi a Cyber Crimes' Victim (2)

I was searching in internet to find more details about what had happened to this beautiful actress .
I found a link that explains after every one watched that clip , the parliament passed a law that says if any of famous actors or actresses found in a a porno the penalty will be execution .
I was totally shocked !!!
How come ? In producing a porno clip there are lots of people like directors , photographers, camera man and so on . Then why the only person who get the penalty is the actor ?
Another thing is that when you can see the personal movies that people make in their private , in people hands , who has the responsibility of this crimes ?
Where is the law ? what if I found my personal birthday party with my friends and family in people laptops and mobile phones ?
Even when you walk in the street in Tehran some times you can hear that some one is selling the porno CDs , and encourage people to buy that by saying that it's an Iranian clip . Hidden sexy cameras and like this .
Unfortunately these clips are spreading day by day and no body cares about the distributors and producers of this shameful products .

Cyber Wars In Iran

Recently there was a conference in Tehran about the 8 month cyber-warfare against opposition websites .
The following link shows what discussed at this conference .

What I recieved from the issues in this conffeernce is that Iranian government are using the young and smart software engineers to work as hackers and also to find the internal hackers and protect the government cyber space .
What they did from 2005 till now are amazing . If u have a look at link that I mentioned you will find that they are totally strong , they attacked to several huge websites like NASA and also they discovered internal hackers who were responsible for cyber-theft of five million dollars from the banks.
In one point of view it would be great because people will be be sure that the cyber space is secure an they can do all transactions online . But in another point of view it can be an activity against human right in Iran to ignore all disagreement against the government.

The new Iran internet law is suspicious !!!

First lets have a look at these news :

Iran has passed a new internet law that experts fear will make information on internet users more readily available to the authorities.

Press TV, a news channel funded by the Iranian government, said on Monday that Mahmoud Ahmadinejad, the country's president, has issued an order for the implementation of the law.

According to Press TV, the cyber law would provide internet users with "more security", as internet service providers are required to save all data sent and received by their clients for at least three months.

But critics of the legislation say the stored data would enable the authorities to monitor internet users, including anonymous bloggers opposed to the regime in the Islamic republic.

http://english.aljazeera.net/news/middleeast/2009/07/2009720132832678525.html

The new Internet law seems to be a tool for creating more security for internet users , but who can believe that government suddenly mentioned that security of websites and blogs are not satisfiable and they have to think about that ?

Some experts believe that this new law can be a tool for monitoring the internet users to put more limitation on that , as the law says that information must keep for 3 month after the data sent or received by the internet clients to the internet service providers .

Internet proxy users in Iran

Using the internet proxy is increasing day by day through the internet users in Iran , internet censorship is the main reason behind that specially after the election , even people in Iran cannot get connected to the Facebook , It's because of the policy that Facebook has , it allows to every one to does any activity through the Facebook . One of these activities is political activities that Iranian did during the election and after that .
Following link shows 2 diagrams that explain the increasing of using the proxy from one of servers before and after the election .

Internet censorship in Iran

According to the latest news near 20 million people in Iran are using internet and also Iran has the 2nd highest internet users in middle east . At first it was so easy to connect to all websites and use the information that were needed .

After election in Iran specially at Khatami's election and the 2nd of khordad reform movement some bloggers started to use the internet as a weapon to express their ideas . But the government couldn't stand this situation and started to block the websites , web loges and put limitation on using internet .

This situation got worst in Ahmadi nezhad election specially in second election .

Manybloggers, online activities , and technical staff have faced jail terms, harassment and abuse.

Recently, the Iran government required all Iranians to register their web sites in Ministry of art and culture. They also plan to filter all other websites up to 2012 .

Where is privacy ? According to what we have learned in cyberlaw no body can not stop you from what you believe and say , till the time that it's not against the humanity .

This censorship not only makes lots of troubles through the using internet and scientific researches but also is a symbol of breaking the human rights .

I hope one day we see the freedom in all layers of Iranian society.

Internet Filtering in Iran

As I was searching through the internet I found a case study about Internet filtering in Iran . It's so interesting , only in one year so many websites , blogs and IDs got blocked .
This research shows how Iranian government are blocking websites to protect themselves from protests and complains .
In this situation how we can expect people to follow the internet and cyber laws when the government are breaking international laws about the internet users' rights ?
Following line shows the research that I mentioned above , have a look at this link .

Electronic commerce Law in Iran

According to my study about business and commerce law in Iran I found that this part of internet law is more important in governments point of view . At least we have a well edited law draft for international trading through internet . Although it's not perfect yet but it can be a good step to reach to the higher steps of cyberlaw in my country .
Following link will give you an overview of electronic commerce law in Iran .

I am a genius not a thief!

28 years old Keyvan is a computer engineer who has educated abroad. He got arrested by the security guard of Iran 1n 9th August 2010.

The reason behind his arrestment is that he accessed to bank security system and he transferred couple of million Tomans to his personal account.

Few days ago he contacted the Bank and said the security system of the bank got many problems and it’s easy to access, but the people in the bank thought that he is making a joke and didn’t take him seriously.

Therefore he decided to transfer the money to his personal account to prove them that the system is weak and the bank realized he transferred the money back to the Bank.

To defense himself at the curt he said: I never attended to steal something from the bank; I just wanted to say that I am a genius.

Also he did access to several government websites and warned them that your security system also got some problems

Researches for this person is still going on .and according to some sources its possible that the security administration use him as a consultant.

Zahra Amir Ebrahimi a Cyber Crimes' Victim (1)

Exactly four years ago a movie showed in an Iranian TV channel that called ''Nargess''. A beautiful actress ''Zahra Amir Ebrahimi'' acted in this movie and absorbed every one's attention . This reputation didn't last for a long time. Few months later every one was talking about this actress and she got the subject of scandals. There was a sexy video of her that included the images of her during having sex and it spread very fast by CDs , DVDs and Internet.
Most of people even had this clip on their mobile phones . BLUETOOTH ......!!!!
What a shame!
Unfortunately it was so late when the governments started to avoid this crime . This actress left the country and nobody knows what happened to the main offender .
Using of mobile is not an offence but when some one do a criminal action , this is an offence.
Who are the offenders in this story ? The first one who spread it for the first time ? People who released it later ?
As we studied in the earlier chapter also mobile phones are a kind of computers base on the ability of processing the informations and transferring the data.
In this post I just want to talk about mobile phones . What do you think if there was a strong law related to the transferring of such a banned videos ?
The issue is the way that this clip released . Maybe each of us has a personal video in our laptops or DVDs , so what will happen if some one do the same thing to us ?
Here cyberlaw will help us , and will protect our PRIVACY against any interference attack.
will be continued ...

INTRODUCTION

The reason that I have chosen this title is the importance of cyberlaw in Iran and the way that the lack of strong cyberlaw can affect Iranian people and their new computerized life . People are suffering from cyber crimes , internet censorship , lack of an inefficient online privacy and so on in Iran these days , more than face to face crimes , and it forces us to investigate these new issues.
I am trying to find those occurrences related to the cyberlaw that happened in my country and still are happening . At least it can clear our minds to feel the necessity of a multi strong cyberlaw in our country.
